If at the meeting with regional officials there were mainly statements of facts and promises to “move” the Navis insurance company, then the leadership of the Vsevolzhsky district determined specific deadlines for the registration of the first two stages for cadastral registration (with the support of a representative of the Rosreestr) and took control of the completion of the construction of the 3rd stage.

The Navis construction company tells its shareholders: “If you are indignant and prevent us from selling, we will not complete the construction for you at all”!

Last weekend - April 1, 2, 2017, a group of shareholders of the Sozvezdie residential complex (long-term construction for 2 years has not been able to put into operation the 3rd stage of the facility, as well as register property for people already living) together with shareholders of the Shcheglovskaya Usadba residential complex (also long-term construction with a two-year delay), came out in protest T-shirts to the construction exhibition at Expoforum. Thus, the deceived shareholders expressed serious dissatisfaction with the policies and behavior of their common developer, the Navis construction company (NDG).

Shareholder of the 3rd stage Natalya: Navis Development Group (NDG) generously pours budgets into advertising and promotion of its new objects “Italian Quarter” and “Scotland”, but almost forgot about its two most problematic unfinished residential complexes - “Constellation and Shcheglovskaya Usadba”, according to who have problems with engineering communications with a permanent circuit. We have been promised for 1.5 years now that they will “just about” be connected and the house will be handed over, but, unfortunately, all these promises from “Navis” still remain promises. Also, inside the house and the adjacent kindergarten and parking lot there are still a lot of deficiencies, about 1-1.5 jobs, especially at the pace of “Navis”. But people can’t wait even longer, 2 years have already passed, we have nowhere to live!”

The shareholders of both problematic long-term construction projects promise that they will hold a series of public actions to attract attention to their problem and put the houses into operation as soon as possible, but the Navis construction company does not agree with this formulation of the issue:

Stage 3 shareholder Sergei: “Our protest was absolutely peaceful, we took copies of our contracts so that the developer would not have a reason to declare, as they always do, that we were “bought by competitors, not real shareholders.” We showed these contracts to everyone who was interested so that no questions would arise. We did not behave rudely, did not pester visitors to the exhibition, we were just walking around, however, the Navis managers did not like this either. One of them told me the following: “If you are indignant and prevent us from selling, we will not finish building you at all, or we will take 5 years to build. We have the right to do this, and you should have read the agreement. It's your own fault." But the housing cooperative agreement does not provide for a complete removal of responsibility from the developer; it also stipulates the deadlines for the delivery of the object, which are now grossly violated. And such arrogant behavior of managers is simply outrageous. Does this appear to be the position of the Navis management as well?

It should also be noted that in order to avoid a large number of shareholders of “Shcheglovskaya Usadba” coming to the real estate fair exactly on the days of the exhibition’s highest traffic, they were organized a personal meeting with the general director of SK Navis A.V. Lvovich and an excursion to the unfinished facility. Shareholders believe that this act of manipulation is intended to extinguish dissatisfaction and again delay the commissioning of the facility. Members of the cooperative have been demanding a meeting with Lvovich for 2 years, but only now, during the exhibition, he appeared before the public, asking to wait another 4 months.

In 2015, an apartment in the Sozvezdie residential complex was one of the most attractive options in the rapidly emerging suburban area of ​​Murino. The biggest problem in this location is transport accessibility, and the Constellation site was located a 10-15 minute walk from the Devyatkino metro station, so new residents could get to the city center in just an hour.

Another advantage of this project was the low (compared to neighboring new buildings) cost of apartments. Because of the price, buyers turned a blind eye even to the absence of an agreement under Law No. 214-FZ, which protects the rights of shareholders. And there shouldn’t have been any problems with housing the children, because next to the new building there is a municipal school, another one was being built in the next block, and they promised to open a kindergarten on the ground floor of building 2b.

The developer Navis Development Group delivered the first phase of the complex almost a year late. The second - with a delay of almost 13 months. This did not frighten buyers of the third stage: in 2015-16, more than half of new buildings were delivered late. But it was the third stage of the Sozvezdie residential complex (the same building 2b where the kindergarten should be) that broke all records for the postponement of commissioning. At first, the developer refused to build a kindergarten promised to buyers. Then, as the media write, problems arose with connecting to the main engineering systems. At the end of 2017, during the State Construction Supervision Commission, it turned out that:

  • building 2b is 11% higher than stated in the project declaration;
  • documentation is not completed as expected;
  • there are 150 fewer parking spaces than promised to residents;
  • deficiencies were found in the fire extinguishing system.

The reasons why the kindergarten was never built were not made public by Navis Group - there is an assumption that the company did not have enough money. According to media reports, the GASN commission demanded the demolition of the top two floors of the building, despite the fact that some of the apartments there had already been purchased.

On the official website of the developer, the third stage of the Sozvezdie residential complex is still listed in the list of objects being sold. They offer to buy an apartment at a price starting from 1.7 million rubles. Mortgage is not available - only one-time payment.

The developer was unable to reach an agreement with the authorities

As of March 2018, the developer had done everything he could: connected the house to heating, water supply and sewerage, and completed all the documents. There is information that the company received permission to make changes to the territory planning project, legalizing the “extra” two floors. But without a kindergarten, permission to open a house is still not given.

It is known that the general director of Navis Group, Alexander Lvovich, addressed the governor of the Leningrad region with a request to allow the building, ready for occupancy, to be put into operation. As an argument, he cited the example of the IQ Gatchina residential complex, which was commissioned in 2016 without social facilities - new residents are still waiting for them. But in response, the head of Navis Group received a categorical refusal. The media have expressed the opinion that the reason for this is the uncompromising nature of the new chairman of Gosstroynadzor, Denis Gorbunov, appointed in February 2018. He has repeatedly stated that he will demand that developers comply with urban planning policies 100%. Having failed to obtain the authorities' leniency, Navis Group announced its intention to finish the kindergarten within two months.

What shareholders of the Constellation residential complex are talking about on the forums

Buyers of apartments do not trust either the developer or government officials. There is information in the group of shareholders on VKontakte that the permit for the construction of the third stage of the Sozvezdie residential complex has been extended for another year. Appeals to the prosecutor's office and officials do not bring results. On February 17, 2018, buyers attended a rally of defrauded shareholders in St. Petersburg and the Leningrad region. There they expressed the opinion that a conflict had occurred between the construction company Navis Group and representatives of the executive power of the Leningrad region, the reasons for which were unknown to a wide audience. This means that it is unknown when this conflict will be resolved and when permission to enter will be given.

Shareholders who make forays into the territory of the abandoned building every day report to the VKontakte group about the presence of workers and the sounds of welding in the kindergarten premises. This gives us hope - maybe the house will really be put into operation by the summer? But if you scroll through the group’s feed to February, it will become clear: no one imagined that the GASN commission would refuse to accept building 2b without a kindergarten. The developer, as well as officials, assured shareholders that this was not a problem.

What can a housing cooperative participant achieve through court?

According to the law on cooperative construction (Section V of the Housing Code of the Russian Federation), members of a cooperative are less protected from the arbitrariness of a construction company than shareholders:

  • the delivery date of the house can be postponed to any date (in shared construction - only for two months);
  • the shareholder is not entitled to a penalty;
  • there is no provision for payment of interest for the use of the shareholder’s funds if he decides to terminate the contract with the construction company.

And yet the shareholder has the opportunity to get the money back and receive compensation. In particular, under Article 15 of the Civil Code of the Russian Federation, the buyer of an apartment may demand compensation for losses that he incurred as a result of the actions of the developer. One of the items of loss is the payment for a rented apartment: it is enough to present the rental agreement and copies of payment documents to the landlord to confirm the expenses. The shareholder may demand a penalty from the construction company in accordance with the Law “On the Protection of Consumer Rights”. True, in this situation the court can reduce the amount of the penalty at its discretion.

Another option is to initiate bankruptcy of the developer and receive the money spent after the sale of his property. After the bankruptcy procedure, shareholders can complete the construction of the house and achieve its commissioning on their own - similar cases have already occurred in the Leningrad region.

I took it in early 2016, in installments; at that time, of all the new buildings in Murino, Navis had the most tempting prices, and loyal installments. Now about the disadvantages: the biggest of them is, of course, the delay in delivery! I even once went to a rally of shareholders, just for fun, it was very actively organized by activists. So, I want to describe my emotions after this gathering. When they were agitating us, they constantly told us that if we didn’t go, then the same thing could happen to us as happened to the notorious CITY. And when I tried to ask a question - why did they decide this, they kept writing to me that they would tell me everything when they met. And naturally I believed that I was doing a good thing, defending my rights. But when I attended this rally and talked with people, I began to understand that something was wrong here. To all my questions and requests to explain why they think that everything is so bad with us, they answered me with almost rudeness and accusations of collusion with the developer. It seemed that people were brought there only for extras. At the same time, in a conversation, one lady openly told me that she did not want to negotiate with Navis, but would continue to terrorize him until she was offered compensation. To say that I was shocked is to say nothing. There was a complete feeling that I was an unwitting participant in some kind of hidden game between builders and “activists,” if you can call them that. As a result, on the advice of friends, I turned to a free legal consultation in my area. Fortunately, I came across a very nice, mature guy, a lawyer. He listened to me very carefully, looked at all the papers and gave me practical advice. What if I really want to find out how things are going at a construction site, then it’s better to go to the builders’ office and ask to look at the official documents. Only this should be done not through shouting at rallies, but calmly, and by registered mail via mail. And that if I don’t threaten or be rude to them, but write my requirements as correctly and clearly as possible, then with a high degree of probability they will be satisfied. Which is what I did. And naturally, even after a month, they answered me in detail in an email where I can see the information I was interested in. So, now I want to ask those who are screaming all sorts of nonsense at the top of their lungs and causing panic among people: who do you work for? Or do you want to earn extra money along the way from other shareholders and equity holders? When you bought an apartment, did you not anticipate possible delays in delivery? After all, on all the sites it was initially written that the delivery of the first stages of houses was also delayed! But people live there and seem to be happy. And in times of crisis, we must, on the contrary, help each other, and not try to benefit from our own neighbors! In general, I want to say that you don’t need to listen to madmen, because as the great Dovlatov said, “The poverty of thought gives rise to legions of like-minded people.”

Developers in the Leningrad region are refusing government help, but not all of them can cope on their own. The authorities of the Leningrad region continue to get out of the difficult situation with long-term construction. They chose an unconventional path, instead of declaring war on careless developers and blaming all the problems of defrauded shareholders on them, officials offered their help. The complex is being built in Murino, 800 meters from the Devyatkino metro station. The developer is Navis Development Group. Two of the three buildings, although with a delay, were put into operation: the first in December 2015, the second in April 2016.

There are still problems with the third one. Shareholders contacted NSP (the facility is being built according to a cooperative scheme). The building has more than 900 apartments. Here is what the activists write: “Our house was supposed to be completed in the second quarter of 2015. We contacted the prosecutor's office and all supervisory and regulatory authorities, right up to the president. As usual, we received replies from everywhere. The construction was frozen for a year, but in the end, through various actions, the shareholders managed to bring our house to the final stage of construction. Today the residential part is 98% ready. And it seems that our problem is close to resolution, and the struggle is almost over. But now the obstacle to completion has become a kindergarten, which according to the project is located on the first floor of our house. At the moment, the premises have been built, but there are no communications or decoration there. Earlier, Deputy Prime Minister of the Leningrad Region Mikhail Moskvin assured us that he would help with organizing the acceptance of a house without a kindergarten. The ex-head of GASN LO Vyacheslav Shibaev explained in detail that if the kindergarten is fenced off with a wall from the residential part, the house can be accepted without it. And last week, a statement was made in the media by the new head of GASN Denis Gorbunkov: the house will not be accepted without a kindergarten.
